Additional charges aren’t likely in the death of a man shot and killed by his brother over the weekend, police said today.
Fernando Soto, 24, of 601 Stoney Glen Circle was fatally shot by his older brother, Felipe Soto Jr., early Sunday morning, investigators said.
The elder Soto, 30, took his brother to the hospital, where he died, police said.
Lt. Gregory Dorn said the shooting occurred at Fernando Soto’s house and stemmed from a family disturbance.
It was unclear whether anyone was at the house besides the two brothers and one other person, 25-year-old Crystal Ann Prim. Dorn said they were having a family cookout Saturday, which carried into the early morning hours on Sunday. Fernando Soto was shot about 2:15 a.m.
Winston-Salem police are continuing to investigate the case, Dorn said, but currently the Forsyth County District Attorney’s Office is not anticipating filing charges in Fernando’s death. It’s believed Felipe Soto fired in self-defense, Dorn said.
Fernando Soto initiated the fight by making verbal threats, Dorn said, and Felipe Soto ultimately defended himself.
Felipe Soto is charged with possession of a firearm by a felon, while Prim is charged with possession of a stolen vehicle and obstruction of justice. She is accused of driving the Sotos to the hospital in a vehicle that was stolen and tampering with evidence. The stolen vehicle was unrelated to the shooting, Dorn said.
He added that police are still investigating who owns the gun that was used, since Felipe Soto is a convicted felon who should not have had a weapon.
Soto is jailed with bail set at $20,000. Prim is jailed with bail set at $15,000. Both are scheduled to have a first appearance in Forsyth County District Court today.
